when you download the upgrade patch, the upgrade directory is present there. this is the directory where you will need to remove the .htaccess which has the DENY ALL line on it, so the upgrade directory would not be accessible if you do not remove it.
but the patch certainly has the upgrade directory. i just upgraded a site from 6.1.6 ---> 7.0.5 wow it all worked and i have screen shots of each upgrade being successful.
